Terms of Service.

1. Acceptance

By using krytekon.com or submitting the Vanguard waitlist form, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the site and do not submit the form.

These Terms form a binding agreement between you and Krytekon LLC, a Texas limited liability company with a mailing address at 5900 Balcones Drive Ste 100, Austin, TX 78731, US ("Krytekon," "we," "us").

2. What this site is

krytekon.com is a pre-launch informational site and waitlist for the Apex Formula — a future dietary supplement product engineered by Krytekon. Krytekon is not currently selling any product. No transaction is occurring on this site. The waitlist exists to notify interested parties when the Apex Formula becomes available and to issue numbered Founding Member credentials to the first cohort.

3. Eligibility

To submit the Vanguard waitlist form you must:

• Be at least eighteen (18) years of age.
• Be a legal resident of the United States.
• Use a valid, working email address that you control.
• Reside in the contiguous forty-eight (48) states, Alaska, Hawaii, or have a U.S. military APO/FPO/DPO address (for future shipping).

We reserve the right to refuse service to anyone for any lawful reason, including suspected automation, abuse, or fraudulent signup.

4. Your obligations

• Submit accurate information.
• Submit only one waitlist entry per person.
• Do not use bots, scripts, or other automated means to submit the form.
• Do not attempt to circumvent rate-limiting, Turnstile, or other security measures.
• Do not impersonate another person or use another person's email address without consent.
• Do not use the site or our communications for any unlawful, fraudulent, or harmful purpose.

5. The Vanguard Founding Member program

We intend to issue numbered Founding Member credentials to the first one thousand (1,000) verified waitlist signups, including the following intended benefits:

• Early access to the Apex Formula at launch.
• A lifetime cohort discount on future Apex Formula orders.
• A numbered physical credential card, shipped before launch.
• Membership in a private Vanguard channel.

The Founding Member program is conditional and not guaranteed. Eligibility, exact benefits, credential design, and timing are subject to a successful product launch and may be modified, suspended, or canceled at our discretion. No monetary consideration is required to join the waitlist; the program is promotional, not contractual.

Founding Member credentials are non-transferable and have no cash value. If you unsubscribe from the waitlist, your credential is forfeited.

6. Dietary supplement disclaimer

Statements made on this site about the future Apex Formula have not been evaluated by the Food and Drug Administration. The Apex Formula is not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified physician before starting any new supplement regimen, especially if you have a medical condition or are taking prescription medication.

7. Intellectual property

The Krytekon name, the Apex Formula name, the Vanguard waitlist concept, the Founding Member program, the Krytekon Creed, the Tactical Monolith design system, the Apex sigil, all written copy, photography, illustrations, and source code presented on this site are the property of Krytekon LLC. You may not copy, reproduce, modify, or commercially exploit any of these without our prior written permission.

You retain ownership of any feedback or suggestions you send us, but you grant Krytekon a worldwide, royalty-free, perpetual license to use that feedback to improve our products and communications.

8. Site availability

We may modify, suspend, or discontinue any part of the site at any time without notice. We may rate-limit, slow, block, or refuse access to any visitor for any lawful reason.

9. Disclaimer of warranties

The site and all communications are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and quiet enjoyment. We do not warrant any specific launch date, formulation, pricing, or program benefit.

10. Limitation of liability

To the maximum extent permitted by law, Krytekon's total cumulative liability arising from or relating to these Terms or your use of the site is limited to one hundred U.S. dollars ($100) or the amount you paid Krytekon in the twelve (12) months preceding the claim, whichever is greater. (At the time of these Terms, that amount is $0 because Krytekon is not currently selling products.)

In no event will Krytekon be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or damage to reputation, even if advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.

11. Dispute resolution

Before filing any formal claim, you agree to notify us at vanguard@krytekon.com with a description of the issue and to engage in good-faith informal negotiation for at least thirty (30) days.

If we cannot resolve the dispute informally, you and Krytekon agree that any claim arising under or relating to these Terms will be brought exclusively in the state or federal courts located in Travis County, Texas. Both parties consent to the personal jurisdiction of those courts.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13. Changes to these Terms

We may revise these Terms from time to time. The "Version" stamp at the top of this page indicates the current revision. Material changes will be communicated to existing waitlist members by email. Your continued use of the site after a revision constitutes acceptance of the revised Terms.

14. Termination

We may remove you from the Vanguard waitlist at any time for breach of these Terms or for any lawful business reason. You may remove yourself at any time by clicking the unsubscribe link in any email we send or by emailing us at vanguard@krytekon.com.

15. Severability and entire agreement

If any provision of these Terms is found unenforceable, the rest remain in full force. These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and Krytekon regarding your use of the site and the waitlist.
